This Privacy Policy sets out the rules for the processing and protection of Personal Data and Cookies of you as a User and Customer of the Online Store available at: *.customcollar.pl

The Controller ensures that data are stored in accordance with applicable law and are not disclosed or sold to third parties. The Controller does not intend to transfer your personal data to an international organization. Your personal data may be transferred to Google LLC on the basis of appropriate legal safeguards. In the event of transfers of the above data outside the European Economic Area, the Controller applies standard contractual clauses adopted by the European Commission or relies on appropriate safeguards under the EU–US Privacy Shield (or equivalent safeguards) to ensure an adequate level of protection.

This Privacy Policy aims, among other things, to specify the activities carried out by the Controller in relation to Personal Data processing, including their collection through the functionalities of the Online Store and the provision of electronic services such as: account creation, placing and processing orders, and the provision of the newsletter service.

Purpose, scope, and legal basis of processing your personal data:

Your Personal Data, as a Customer of the Online Store, are collected (or will be collected) through the following Online Store functionalities:

contact forms and their configurators,

the provision of an online account service: providing the data necessary to create an account and to log in to the Online Store.

Additionally, the Controller is authorized to automatically obtain and record data transmitted to the server by customers’ web browsers or devices, e.g., IP address, software, hardware parameters, pages viewed, mobile device identifier, as well as other data concerning devices and the use of the system.

The Controller processes your Personal Data necessary for the proper performance of services available in the Online Store and is authorized to use the data collected and stored within the Online Store for the following purposes:

placing an order in the Online Store,

handling complaints,

direct marketing upon your consent,

ensuring proper operation of the Online Store account(s), including in particular creating and managing the account(s), resolving technical and other issues, and providing appropriate features,

adapting offers, advertisements, and statements for the User,

monitoring activity in the Online Store of all and specific Users,

contacting Users, in particular for the purposes related to the provision of services, customer support, as well as marketing and advertising activities to which you have given separate consent,

analyzing Customer activity in the Online Store, including profiling, i.e., automated processing of Personal Data collected from the customer for the presentation of advertisements, offers, promotions of the Controller’s and its partners’ products and services tailored to the Customer’s profile of interests (without affecting the Customer’s decisions),

conducting analyses and research of available services to improve their operation,

accounting and tax purposes,

the possible establishment, exercise, or defense of legal claims,

concluding and performing contracts.

For the purpose of fulfilling an order, the Controller processes your data in the scope of: country, recipient’s first and last name/company name, postal code, post office, town/city, street, building number, apartment number, e-mail address, phone number, and additionally for a Company or B2B Partner: company name, company address (street, building/apartment number, postal code, town/city), VAT ID.

For the purpose of registering a Customer Account, the Controller processes your personal data in the scope of: first name, last name, e-mail address and, additionally for a B2B Partner: country, company name, company phone, company fax, VAT ID, company e-mail address, company address (street, building number, apartment number, postal code, town/city) and contact person details (first name, last name, e-mail address, phone).

For the purpose of contacting us via the contact forms available at customcollar.pl, the Controller processes your personal data in the scope of first name, last name, e-mail address, contact phone.

For the purpose of submitting a product review on the website of the Store, the Service Provider/Seller collects the following Customer data: first name and e-mail address.

The Controller declares that providing the data indicated in sections 4, 5, and 6 above, marked in the Online Store as required, is voluntary, but necessary to conclude and perform contracts or to obtain contact with the personal data controller. Providing the data for the purpose specified in section 7 is voluntary.

DISCLOSURE OF PERSONAL DATA TO OTHER ENTITIES

Your personal data may be made available to other entities in the event that you give voluntary consent to share such data with entities you indicate in your statement, or in the event of an obligation to disclose personal data arising from generally applicable laws to entities authorized to receive them, in particular: the public postal operator, law enforcement authorities, courts.

Your Personal Data may also be disclosed to other entities in order to carry out specific activities in the Online Store, i.e.:

to make payments for purchases,

to deliver purchased products.

Access to your Personal Data is granted to the above entities to the extent necessary and only to such extent that ensures the performance of their services so that you can order and receive the Goods and pay for them.

Your Personal Data may also be disclosed to the Controller’s partners, such as:

entities that technically and programmatically support the Controller’s Online Store,

entities that support the Controller in communicating with the customer by means of electronic communication,

entities that help prepare offers and marketing campaigns for the Online Store’s Customers,

entities collecting product and store reviews.

Your personal data will always be disclosed to other entities with respect for the security of your personal data by imposing on those entities obligations to keep such data confidential. The Controller will select only such entities to provide services to it that provide adequate guarantees of meeting the requirements arising from the GDPR.

Please note that your personal data in the scope of the customer ID number may be transferred to Google LLC as part of the implementation by G8DBOY Sp. z o.o. of Google Analytics services for statistical analysis purposes.

NEWSLETTER AND COMMERCIAL INFORMATION

Your personal data will be processed for the purpose of sending commercial information by electronic means, including the provision of the Newsletter service, only if you have given voluntary consent. Providing your data is voluntary in this case; however, to provide the service, it is necessary to provide your e-mail address in the contact form available at https://customcollar.pl

Via the Newsletter, you will receive information about current offers, promotions, news, and other special actions organized in the Online Store and the Controller’s sales outlets.

LEGAL BASIS FOR DATA PROCESSING

Your personal data processed for purposes related to the performance of the contract for the provision of electronic services and the sales contract will be processed on the basis of Article 6(1)(b) of the GDPR. At the same time, the Controller will be entitled to process your data necessary to establish, shape the content, change or terminate the legal relationship established between you and the Controller on the basis of Article 6(1)(f) of the GDPR in connection with Article 18 of the Act on the Provision of Electronic Services. Processing your data for the purpose of marketing the Controller’s own products and services, automated data processing, and for competition purposes will be carried out on the basis of Article 6(1)(a) of the GDPR. Processing of personal data for the purpose of possible establishment, exercise, or defense of legal claims as our legitimate interest will be based on Article 6(1)(f) of the GDPR. Additionally, processing your data for the purpose of sending you information about the Controller’s products and services will be based on Article 6(1)(a) of the GDPR. Processing for accounting and tax purposes will be carried out on the basis of Article 6(1)(c) of the GDPR.

COOKIES POLICY

The Controller automatically collects information contained in Cookies to gather data related to the use of the website by the Customer or User. Cookies are small text fragments that a website sends to the Customer’s browser and which the browser sends back upon subsequent visits to the site. They are mainly used to maintain a session, e.g., by generating and sending a temporary identifier after logging in.

The Controller uses “session” (temporary) Cookies, which are stored on the Customer’s end device until they log out, leave the website, or close the web browser, and “persistent” Cookies, which are stored on the Customer’s end device for the time specified in the Cookie parameters or until they are deleted by the Customer.

Within the Online Store, the Controller uses the following types of Cookies:

“necessary”, which enable the use of services available within the Online Store,

those used to ensure the security of the Store and its users,

“advertising”, which enable the delivery of advertising content tailored to the User’s interests,

“performance”, which are used to obtain information on how Users use the Online Store website,

“functional”, which allow remembering the functionalities preferred by the User of the Online Store.

The service provider uses third-party Cookies to collect statistical data via analytical tools, e.g., Google Analytics.

Cookies tailor and optimize the Online Store and its offer to the needs of Customers through actions such as creating page view statistics of the Online Store and ensuring the security of the Online Store and its Users.

Cookies are also required to maintain the Customer’s session after leaving the website; they allow the Customer to return to the contents of the cart without losing its products, which would otherwise require re-selecting the Goods.

You have the ability at any time to delete or block collected Cookies using your web browser.

Disabling or blocking the Cookies referred to above may hinder or prevent the use of certain functionalities of the Online Store, which you are entitled to do; however, you should be aware that this will entail limitations of functionalities available on the Online Store website.

Technology using Cookies makes it possible to present advertisements and offers tailored to your shopping preferences.

Knowledge about your activity on the Online Store website and other websites using Cookies also makes it possible to conduct statistical and market analyses.

Opting out of Cookies does not mean that you will not receive advertisements while browsing the Online Store; however, they will not be tailored to your most recent activity in the Online Store.

REMARKETING

Thanks to Cookies, it is possible to use technology that allows us to reach users who have previously visited the Online Store with advertising messages. Advertising messages are displayed to them on other websites they visit, including those belonging to entities cooperating with our partners.

HOW WE SECURE PERSONAL DATA

The Controller applies technical and organizational measures to ensure the protection of processed Personal Data appropriate to the risks and categories of Personal Data protected, and in particular secures the data against disclosure to unauthorized persons, taking by an unauthorized person, processing in violation of applicable laws, and change, loss, damage, or destruction.

The Controller provides the following technical measures to prevent unauthorized acquisition and modification of Personal Data transmitted electronically:

Storing Personal Data on secured servers,

Applying appropriate security of the data set against unauthorized access,

Providing access to the Account through an individual login and password,

Using SSL certificates on the Online Store pages

Your rights in relation to data processing by the Controller. You have the right to request from the data controller access to personal data, rectification, erasure where excessive or untrue, restriction of processing, the right to object to further processing for reasons related to your particular situation, or when they are processed for marketing purposes, including profiling, to the extent that the processing is related to such direct marketing.

You have the right to withdraw any consent you have given to the processing of your data, including their disclosure, at any time without affecting the lawfulness of the processing carried out on the basis of consent before its withdrawal.

You have the right to lodge a complaint with the supervisory authority in relation to the processing of personal data.

PERIOD OF PROCESSING YOUR PERSONAL DATA

Your personal data will be stored for the period necessary to conclude and perform the Contract, after which the data will be stored for the period appropriate for the statute of limitations for claims and criminal acts (the limitation period for claims in business relations is usually 3 years, while in the case of contracts concluded with consumers, excluding periodic claims, this period is 10 years). Processing of data for accounting and tax purposes will, as a rule, take place for a period not shorter than 5 years, with specific periods set out in legal regulations, e.g., tax regulations. In addition, your personal data processed on the basis of voluntarily given consent will be processed until you withdraw your consent. Personal data processed on the basis of the Controller’s legitimate interest will be processed until you object to the processing of your personal data for the purposes of such interests, although there may be situations where, despite your objection, the Controller may continue to process your personal data, e.g., for the pursuit of claims.
